Making a will is an important step and should not be left to chance. There are many reasons why it is
important to make a will including that:

Probate and Estate Administration
If you have recently suffered a bereavement and are looking for help in dealing with the property and
affairs of someone who has died we can help.
Dealing with the affairs of someone who has passed away can be difficult, confusing and worrying at
an emotionally difficult time.
We can help where the person who died left a will (“probate”) and in cases where there was no will
(“administration”).
Probate (where there is a will) and Administration (usually where there is no will) together referred
to as “Letters of Administration” is the process whereby the court grants authority to someone to
deal with the deceased’s property and assets including where applicable their bank accounts, house
and other possessions and is usually required if the deceased has assets exceeding £10,000 in any
one bank account.
The job of dealing with the estate of someone who has passed away carries many responsibilities
including;
- Making necessary enquiries to establish what property and assets the deceased had
- Arranging the funeral
- Dealing with the deceased’s tax affairs and those of the estate including claiming all available
reliefs and completing all necessary tax returns (penalties may apply if these are not dealt
with correctly)
- Arranging to close/transfer any bank accounts and deal with the sale of any shares or cashing
in/transfer of other investments
- Arranging clearance of the house or flat where appropriate and valuation of contents
- Paying bills and outstanding liabilities
- Carrying out the wishes of the deceased in any will
- Distributing the money and property in accordance with either the will or under the
Intestacy Rules if there is no will

Many cases achieve an early out of court/tribunal negotiated settlement in which case the legal costs could typically range between £ 10 - £ 15,000 plus vat and disbursements on average but more (and even a multiple of that figure) in some complicated cases. The disbursements would include court fees and barristers fees in some more complex cases which vary considerably depending upon the seniority of the barrister selected but which could be similar or equivalent to and in addition to our own fees.

Lasting Power of Attorney
Without Lasting Powers of Attorney it can be difficult for your friends and family to help you if you
lose mental capacity (for example) due to accident or illness and can sometimes result in social
services trying to take taking control of your affairs – sometimes against the wishes of your friends
and family.
A lasting power of attorney is a document whereby you can give someone legal authority to look
after you and make important decisions for you if for example you suffer an accident or an illness or
for some reason can’t deal with matters yourself. Unlike some general powers of attorney a “Lasting
Power of Attorney” continues even if you lose mental capacity.
There are two types of Lasting Power of Attorney:
- Health and Welfare:
(this enables your attorney to make decisions regarding matters such as
medical care, whether you are cared for at home or moved to a nursing home, your daily
routine and life sustaining treatment
- Property and Financial Affairs :
(this enables your attorney to make decisions about your
financial matters including paying bills on your behalf, selling your home, operating your
bank account).
You can give your attorneys general authority to deal with your affairs or if you wish you can place
limitations on what they are able to do for you. Your attorney is under an obligation to act in your
best interests.
You can appoint one or more attorneys to act on your behalf. Your choice of attorney is an important
decision and should be someone that you can trust.
You must have mental capacity in order to make a Lasting Power of Attorney. If you have already lost
mental capacity then it may be possible for the person wishing to look after you to apply to the Court
of protection to be appointed as your deputy (please telephone for details) however this process is
more complicated and involves significantly more cost that with Lasting Powers of Attorney.

Children - Child Arrangements Orders
Deciding which parent the children should live with following a divorce or separation can be a
difficult process. Decisions also need to be made in the best interests of the child or children
regarding when the children will see the other parent, where the children will live, what school they
will attend and other matters regarding their welfare.
Child Arrangements were introduced by the courts in 2014 and replaced what were previously
known as residence and contact orders.

Pre-Marriage Agreements (Pre-Nuptial Agreements)

Court of Protection
If you have a friend or family member who is no longer able to make decisions on their own perhaps
due to illness, age or infirmity then you may be able to apply to the Court of Protection to be
appointed as their “deputy” in order that you can help them and make decisions on their behalf
regarding their finances and other matters. This is often done in cases where the patient is unable to
sign a Lasting Power of Attorney (usually because they have already lost mental capacity).
The application process for a deputyship order can be complicated and David Tagg & Co are able to
advise you and complete the application on your behalf and advise you generally regarding your
duties as a deputy.
Deputyship order can also be of assistance where there is a dispute regarding what type of social
care is in a person’s best interest or where you are concerned about the level of care a person is
receiving or where you are already looking after another person but need to make matters official for
theirs and your own protection.

Inheritance Tax Planning
Inheritance Tax Planning
We can advise you about trying to reduce the amount of inheritance tax (previously known as death
duties) payable by your estate after your death.
This can be important since the amount of inheritance tax payable by some estates can be very high
(often as a result of the increase in property prices and the value of the family home) and many
estates that would once have been exempt are now chargeable.
Inheritance tax is a complex area of law however in many cases it is possible to reduce the tax
payable (or avoid it altogether) by planning matters in advance. This is often done in conjunction with
the preparation of your will.
Inheritance tax is often relevant if the value of your assets is in excess of £325,000. The usual rate of
inheritance tax is 40%. Various exemptions (such as the “spouse exemption”) and reliefs may apply.
There are many methods for reducing inheritance tax and not all are complicated. Inheritance tax
planning may save tax on your estate and leave more money for you family and loved ones.

Pre-Nuptial Agreements and Living Together
No one gets married expecting it to fail. Statistics show however that over
a third of marriages will end in divorce.
A Pre-Nuptial is a way in which the parties can try to agree in advance a
fair financial settlement in the event that the relationship breaks down.
Pre-Nuptial agreements can help avoid costly disagreements and litigation
and may prove to be money well spent.
Pre-Nuptial agreements are often used to try to protect or "ringfence"
assets which one party may have accumulated on their own before the marriage
against a claim by the other party in the event of a divorce.
For a Pre-Nuptial agreement to have a chance of being binding in the event
of a divorce it is essential that the correct steps are followed including
that each party has their own legal advice, that each party discloses their
assets to the other and preferably that the agreement is signed 28 days
(sometimes 21 days) before the date of the marriage.
If you are not married but are living with your partner then it is possible
to have a "Living Together Agreement" dealing with the division of money and
assets in a similar way in the event that the relationship breaks down.
